Big win for PA stip clubs
"In a major Victory for free expression, a federal appeals court in Philadelphia has invalidated two PA laws which prohibited nudity in any establishment where alcohol was served.
At issue was whether the state could ban "lewd" activity on liquor permit premises without violating the constitutional guarantee of free expression. In August, a three judge panel of the united states court of appeals for the Third Circuit unanimously held that it could not.
In a sweeping decision vindicating the rights of entertainers and the establishments in which hey perform, the court of appeals struck down the liquor statute and regulation in their entirety. The court held that the laws swept too broadly, prohibiting both erotic and main stream productions that are protected by the first Amendment. Five weeks later, the court declined a request by the state to reconsider its decision.
PA had a long history of aggressively interpreting the laws in question. Clubs throughout the state were subject to the prohibitions which the state had interpreted as banning, among other things, all nudity any place alcohol is served. The broad interpretation helped to seal the fate of the law. In it's opinion, the court of appeals note that state liquor officials had even claimed that a televised image of a bare-breasted woman in a bar would run afoul of the law.
The state has the right to seek a review of the decision by the supreme court. Unless that court agrees to hear the case on appeal, however, cabarets and dancers throughout the state will finally be free from a half-century old law which imposed severe restrictions on their performances."
This is a HUGE win for club owners. And it continues to show that many old laws to restrict adult clubs are in fact, unconstitutional, and one by one are being struck down. I can only see good things in the future for adult clubs, as now, Club10, if they choose to, could purchase a liquor license, and serve alcohol ion the club and the dancers can continue to be fully nude

Wow, thats pretty big. Considering how hard there were on clubs that have dancing girls and serve booze.
I am sure "you know who" will be on an uproar. This may make it a little easier to open the club in Pittston again.

Actually, I would call it justice. You think it is filth, others do not think so.
It just shows that the courts are finally realizing how ludicrous the older laws are that were out in place when religious leaders made those laws.

You would think it is that easy Eric, but they go out of there way to try to prove that these places harm everyone around them. Because they do not approve of nudity, they go to great lengths to try to force out anything they do not approve of.
As it turns out, the courts have realized that secondary effects are not true, and more often now, find in favor of adult clubs.
The judges were all perverts. It's that simple. Whe else would they rule this way. Make me sick
I have realized something about people in this area, that they are never happy with anything. People will complain about this strip club, if it is gone, they will move to something else.
I was just reading on the WNEP boards where people are yelling at others for holiday shopping. Telling them to stop spending their money on Black Friday. Are we ever happy? No.
If this valley was free of adult clubs, they would only find other things to complain about.
They complain about the hunters, the casino, holiday spending, strip clubs, driving, every little thing they can find to complain about, they will.
We can not learn to just enjoy what we have, and live, instead we must always force ourselves into others affairs.
People will bitch about anything they do not like. That will never change. And they can always find the words to justify their compaint. No matter how retarded it is

What makes you sick? the fact that others enjoy something you do not, or can not understand why others do?
Or just the fact the judicial system has seen throught the religious smoke cloud of false information like secondary effects.
